Welcome to www.gardenofzen.in (the “Website”). These Terms & Conditions (“Terms”) govern your access to and use of the Website, and any purchase of products from Garden of Zen (“Garden of Zen”, “we”, “us”, “our”). By accessing the Website, browsing our products, or placing an order, you (“you”, “your”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Website.

These Terms should be read together with our Privacy Policy, Shipping Policy, and Return & Refund Policy. Each of these policies is incorporated into, and forms part of, these Terms. Where a specific policy addresses a matter in more detail than these Terms, that policy will govern on that matter.

1. About us

2. Eligibility

To use the Website or place an order, you confirm that you:

• are at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872;
• are using the Website for your own personal, non-commercial use, unless we have agreed otherwise with you in writing; and
• will provide accurate, current, and complete information when placing an order or contacting us.

We may refuse service, cancel an order, or restrict access to the Website where we reasonably believe these conditions have not been met.

3. Use of the Website

When using the Website, you agree that you will not:

• use the Website for any unlawful purpose or in a manner that violates any applicable law;
• attempt to gain unauthorised access to the Website, our systems, or any related account;
• scrape, data-mine, or use automated means to access or copy the Website without our prior written consent;
• impersonate any person, or place fraudulent or speculative orders; or
• copy, reproduce, or commercially exploit any part of the Website without our prior written permission.

We may suspend or terminate your access to the Website, and/or cancel any pending order, if we reasonably believe you have breached this section.

4. Products

Our aromatic oils are fine fragrance oils intended for ambient and home use. They are not intended for ingestion or direct application to skin unless expressly stated on the product label, and we do not make or intend any medicinal, therapeutic, or curative claims about them.

Product images are indicative only. As our oils are hand-poured in small batches, natural variation in colour and scent intensity may occur between batches. Discontinue use immediately if irritation or any adverse reaction occurs, and seek medical advice if needed. Keep all products away from children and pets, avoid contact with eyes, and store away from open flame and direct heat — the oils are flammable. All products are made in India and labelled in accordance with applicable Indian packaging and labelling requirements.

5. Pricing

All prices on the Website are listed in Indian Rupees (₹) and are inclusive of applicable taxes, including GST, unless stated otherwise at checkout. We may change prices at any time without prior notice; the price that applies to your order is the price shown on the Website at the time your order is placed and confirmed.

If a product is listed at an incorrect price because of a typographical, technical, or pricing error, we may cancel the affected order and will refund any amount already paid in full.

6. Orders & acceptance

Placing an order is an offer by you to purchase the relevant product(s), which we may accept or decline at our discretion. Your order is confirmed only through your own explicit action at checkout, and never through a pre-ticked or default option.

We may cancel or decline an order because of stock unavailability, a pricing or listing error, a delivery-address issue, or suspected fraudulent or unauthorised activity. Where an order is cancelled after payment, we will process a full refund in line with our Return & Refund Policy; we do not charge you a cancellation fee unless we would also bear an equivalent cost ourselves.

7. Payment

We accept payment through our secure payment gateway, Razorpay (covering major cards, UPI, net banking, and wallets), and by cash on delivery (“COD”) where this is offered at checkout for your delivery location. Prepaid orders are processed only once payment is confirmed.

We do not store your full card, UPI, or banking credentials — these are handled directly by our payment gateway partner. If a payment fails, is declined, or cannot be verified, we may cancel the related order.

8. Shipping & delivery

Delivery of your order is governed by our Shipping Policy, which forms part of these Terms and sets out our delivery timelines, service areas, and charges.

9. Cancellations, returns, refunds & replacements

Cancellations, returns, replacements, and refunds are governed by our Return & Refund Policy, which forms part of these Terms and sets out eligibility, timelines, and how to raise a request.

10. Reviews & content you submit

If the Website allows you to submit reviews, ratings, photos, or comments (“User Content”), you confirm that it is genuine, based on your own experience, and not misleading, defamatory, or unlawful. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display your User Content in connection with the Website and our marketing. We may remove any User Content at our discretion, including anything we believe to be fake, undisclosed paid promotion, or in breach of these Terms.

11. Intellectual property

All content on the Website — including the “Garden of Zen” name and logo, text, product photography, packaging design, and layout — belongs to or is licensed to us and is protected under applicable Indian intellectual property law. Nothing in these Terms gives you any right to use our trademarks, trade names, or content, and no part of the Website may be copied, republished, or used commercially without our prior written permission.

12. Third-party links & services

The Website may link to third-party websites or services, including our payment gateway and our social media pages. We do not control, and are not responsible for, the content or practices of any third-party site, and your use of any such site is at your own risk and governed by that site’s own terms.

13. Disclaimer of warranties

The Website and our products are provided on an “as is” and “as available” basis. To the fullest extent the law allows, we make no warranties, express or implied, as to merchantability, fitness for a particular purpose, or non-infringement, other than any rights you hold as a consumer under the Consumer Protection Act, 2019, which cannot be excluded. We do not guarantee that the Website will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Garden of Zen will not be liable for any indirect, incidental, or consequential loss arising from your use of the Website or our products. Our total liability for any claim relating to your order is limited to the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under Indian law, including the Consumer Protection Act, 2019.

15. Indemnity

You agree to indemnify and hold harmless Garden of Zen, its founders, and its employees from any claim, loss, or liability arising from your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.

16. Force majeure

We will not be responsible for any delay or failure to perform our obligations under these Terms where this is caused by circumstances beyond our reasonable control, including natural disasters, strikes, courier or logistics disruptions, government action, or power or internet outages.

17. Grievance redressal

In line with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, we have appointed the Grievance Officer named below to handle complaints about the Website or your order. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt.

If you remain unsatisfied with our resolution, you may also contact the National Consumer Helpline (toll-free 1800-11-4000 or short code 1915), or approach the Consumer Disputes Redressal Commission with jurisdiction over your complaint under the Consumer Protection Act, 2019.

18. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to the paragraph below, the courts at Kolkata, West Bengal will have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

Nothing in this clause affects your statutory right as a consumer to approach the District, State, or National Consumer Disputes Redressal Commission with jurisdiction over your own place of residence, under the Consumer Protection Act, 2019.

19. General

• Severability — if any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
• Waiver — our failure to enforce any provision at any time is not a waiver of our right to enforce it later.
• Assignment — we may assign or transfer our rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets; you may not assign your rights under these Terms without our written consent.
• Entire agreement — these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, make up the entire agreement between you and us regarding your use of the Website.

20. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, products, or applicable law. The revised Terms will be posted on this page with an updated “last updated” date. Your continued use of the Website after any change is posted means you accept the revised Terms.
